This site and its components are offered for informational purposes only; this site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information.

The Site and its original content, features, and functionality are owned by Rock Ness Studios Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Payment Terms and Conditions

Payments to Rock Ness Studios Ltd are currently accepted by Bank Transfer, PayPal or by Cheque. Unless otherwise agreed in writing between Rock Ness Studios Ltd and the client(s), payments must be made in full by the client(s) prior to delivery of any deliverables by Rock Ness Studios Ltd.

Clients commissioning services from Rock Ness Studios Ltd will receive a quote for initial costs, and upon acceptance will be sent an invoice for the agreed amount(s) along with a contract outlining full terms and conditions for the project(s), including but not limited to payment, termination, and delivery terms.

In the event of a project overrunning its quoted time, Rock Ness Studios Ltd will advise and discuss with the client(s) regarding whether additional costs will be required. In the event that additional costs are agreed, these will be sent as separate invoices to the original project invoice. Rock Ness Studios Ltd reserves the right to withhold delivery of final project deliverables until all outstanding payment(s) have been received.

Invoice payments are due within 30 days of their issue date. For every 7 days invoices are overdue, a late fee of 10% of the original invoice amount will be applied on top of the outstanding balance and must be paid in full along with the original costs, unless otherwise agreed in writing with Rock Ness Studios Ltd.

Liability for Physical Media Items

For audio restoration and / or transferral services involving physical media (e.g. cassette tapes, compact discs or DVDs), the client accepts all responsibility for the postage and condition of the item(s) sent to Rock Ness Studios Ltd. Items should be mailed to Rock Ness Studios Ltd by recorded delivery. When returning items to the client(s), Rock Ness Studios Ltd will always use recorded delivery, and provide tracking number(s) where available. Rock Ness Studios Ltd does not accept any responsibility or liability for any physical items in transit with courier companies or postal services, and will not be held accountable for any loss or damages.

Due to the variable complexity of audio restoration, Rock Ness Studios Ltd makes no guarantees about the level of service that can be delivered on these projects. In the event that Rock Ness Studios are unable to complete a restoration, or the level of restoration does not make a considerable improvement, Rock Ness Studios Ltd may offer a reduction to the amount invoiced during intial discussions with the client(s). This reduction offering and the amount(s) in question are entirely at the discretion of Rock Ness Studios Ltd.

Mixing and Mastering projects

Rock Ness Studios Ltd will discuss all mixing and mastering projects with clients prior to commencement of any work to identify the desired sound, objectives and requirements. Where possible, clients may be asked to provide demos and / or reference tracks which can be used during the mix process.

Clients are responsible for the delivery of any electronic files relating to mixing and / or mastering projects which are deemed necessary for Rock Ness Studios Ltd to be able to complete their work. Rock Ness Studios Ltd accepts no responsibility for any delay(s) to delivery deadlines or otherwise agreed dates where information or files are pending from the client.

Rock Ness Studios Ltd will provide three rounds of revisions to mixes / masters (i.e. the intial mix / master, followed by up to two rounds of changes) included in the project cost for any mixing or mastering projects. In the event the changes requested by a client are deemed to not be minor edits or would otherwise heavily impact delivery, additional charges may be issued by Rock Ness Studios Ltd.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Notification of Changes

The company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers' Personally Identifiable Information, notification by email or postal mail will be made to those affected by the change. Any changes to our privacy policy will be posted on our site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.
